Strikd Technologies S.A.P.I. de C.V. (“STRIKD”, “nosotros”, “nos” o “nuestro”) es responsable del tratamiento de los datos personales descritos en este Aviso.

La persona o área responsable de dar trámite a solicitudes de protección de datos será la función interna de Privacidad y Cumplimiento de STRIKD, localizable mediante el correo anterior.

Este Aviso se aplica a la Aplicación móvil de STRIKD; el sitio web; páginas de Programas del Atleta; procesos de registro, checkout y suscripción; Motor Adaptativo; funciones de entrenamiento; perfiles; Canales y Chats; soporte; moderación; notificaciones; y demás productos o funciones identificados como parte de STRIKD.

No regula el tratamiento independiente realizado por Apple, Google, Stripe, redes sociales, gimnasios, Atletas cuando actúan fuera de STRIKD u otros terceros que determinen sus propios fines. Debes revisar sus avisos de privacidad cuando corresponda.

STRIKD podrá tratar las siguientes categorías, según las funciones que utilices:

STRIKD no necesita que proporciones diagnósticos clínicos detallados, expedientes médicos completos, datos biométricos de identificación, información genética ni datos financieros completos para utilizar las funciones ordinarias. No envíes información que no sea necesaria para la finalidad correspondiente.

• directamente de ti, al crear la Cuenta, completar el onboarding, registrar entrenamientos, publicar, enviar mensajes, reportar contenido, solicitar soporte o ejercer derechos;
• automáticamente, cuando utilizas la Aplicación, sitio, webviews, notificaciones, Motor Adaptativo, funciones de comunidad o sistemas de seguridad;
• de Procesadores de Pago y tiendas, para confirmar compras, Suscripciones, renovaciones, cancelaciones, reembolsos y estado de acceso;
• de Atletas y otros Usuarios, cuando interactúan contigo, te incluyen en contenido, reportan un mensaje o escalan una Cuenta; y
• de proveedores técnicos que operan por cuenta de STRIKD, dentro de las finalidades y límites contractuales aplicables.

Esta sección describe de forma específica el tratamiento de la información que STRIKD recibe de Google cuando eliges crear tu Cuenta o iniciar sesión con Google (los «Datos de Usuario de Google»). Complementa el resto de este Aviso y, en lo relativo a esos datos, prevalece sobre las descripciones generales.

El inicio de sesión con Google opera mediante OAuth 2.0. STRIKD nunca recibe ni almacena tu contraseña de Google. Solo recibimos los campos correspondientes a los alcances que apruebas en la pantalla de consentimiento de Google.

STRIKD no solicita ni recibe acceso a tu Gmail, Google Drive, Contactos, Calendario, Fotos, ubicación ni a ningún otro servicio de Google. Si en el futuro una función requiriera un alcance adicional, se te pedirá un consentimiento nuevo y específico antes de habilitarlo, y podrás negarlo sin perder el acceso a tu Cuenta.

Finalidades. Los Datos de Usuario de Google se utilizan exclusivamente para proveer y mejorar funciones visibles para ti dentro del Servicio:

• crear, autenticar, mantener y recuperar tu Cuenta;
• mostrar tu nombre y tu foto de perfil en tu Cuenta y, si decides participar, en la Comunidad;
• enviarte comunicaciones necesarias sobre tu Cuenta, tu Suscripción y tu entrenamiento;
• prevenir fraude, abuso, suplantación y accesos no autorizados;
• atender el soporte que tú solicitas e identificar tu Cuenta al hacerlo;
• cumplir obligaciones legales aplicables.

STRIKD no utiliza los Datos de Usuario de Google para ninguna finalidad secundaria sin obtener antes tu consentimiento separado, en los términos de la sección de Consentimientos Separados de este Aviso.

Con quién pueden compartirse. Los Datos de Usuario de Google se comparten únicamente en los siguientes supuestos:

• con Encargados que operan la infraestructura del Servicio por cuenta de STRIKD —autenticación, hosting, base de datos, notificaciones, correo transaccional, soporte y analítica de producto—, sujetos a contrato, deber de confidencialidad e instrucciones de STRIKD, y sin derecho a tratarlos para fines propios;
• contigo y con quienes tú decides: tu nombre y tu foto de perfil son visibles para otras personas usuarias si participas en la Comunidad, y puedes ocultarlos o sustituirlos desde la Aplicación;
• cuando una autoridad competente lo requiera conforme a la ley, o cuando sea necesario para ejercer o defender derechos de STRIKD;
• en una operación corporativa —fusión, adquisición, reestructura o venta de activos—, informándote conforme a la sección de Cambios al Aviso y manteniendo el nivel de protección aquí descrito.

STRIKD no vende, renta ni cede los Datos de Usuario de Google a corredores de datos, redes publicitarias ni a terceros para sus propios fines.

Cómo se protegen. Los Datos de Usuario de Google se resguardan con las siguientes medidas:

• cifrado en tránsito mediante TLS y cifrado en reposo en la base de datos y en los respaldos;
• control de acceso por rol y por necesidad de conocer, con autenticación reforzada para el personal autorizado;
• registro y revisión de accesos, y separación estricta entre los entornos de producción y de desarrollo;
• almacenamiento de los tokens de acceso y de actualización en un almacén cifrado, revocables en cualquier momento y renovados de forma periódica;
• evaluación periódica de vulnerabilidades y procedimientos de respuesta a incidentes conforme a la sección de Seguridad y Vulneraciones de este Aviso.

Ninguna persona lee tus Datos de Usuario de Google, salvo: (i) con tu consentimiento expreso; (ii) cuando resulte indispensable por seguridad, investigación de abuso o cumplimiento de la ley; (iii) de forma estrictamente limitada para operar o reparar el Servicio cuando el tratamiento automatizado no sea suficiente; o (iv) cuando se trate de datos agregados o anonimizados que ya no permitan identificarte.

Cómo se eliminan. Puedes eliminar los Datos de Usuario de Google por dos vías independientes:

• Revocar el acceso de STRIKD desde tu Cuenta de Google, en myaccount.google.com/permissions. La revocación impide de inmediato que STRIKD obtenga nueva información de Google; por sí sola no elimina la información ya almacenada en STRIKD, para lo cual debes eliminar tu Cuenta.
• Eliminar tu Cuenta STRIKD desde la Aplicación, normalmente en Configuración > Cuenta > Eliminar Cuenta. STRIKD eliminará o desidentificará tu nombre, tu correo, tu identificador de Google y tu foto de perfil dentro de un plazo de hasta treinta días, salvo la información sujeta a bloqueo o conservación legal. Los respaldos cifrados se sobrescriben en el ciclo ordinario, que no excede noventa días.

También puedes solicitar la eliminación escribiendo a admin@strikd.ai desde el correo asociado a tu Cuenta de Google, y ejercer tus derechos de acceso, rectificación, cancelación y oposición conforme a la sección de Derechos ARCO de este Aviso.

Uso Limitado. El uso y la transferencia que STRIKD hace de la información recibida de las API de Google se apega a la Política de Datos de Usuario de los Servicios de API de Google, incluidos sus requisitos de Uso Limitado. De forma expresa:

• los Datos de Usuario de Google no se venden ni se monetizan de ninguna forma;
• no se usan ni se comparten para publicidad, incluida la publicidad personalizada, el retargeting, la segmentación por audiencias o la creación de perfiles publicitarios;
• no se usan para entrenar, ajustar ni evaluar modelos generales o de base de inteligencia artificial, propios o de terceros;
• el Motor Adaptativo de STRIKD trabaja únicamente con tus datos de entrenamiento y rendimiento para personalizar tu propio programa dentro de tu Cuenta, y no recibe tu nombre, tu correo ni tu foto de perfil de Google para esa finalidad.

STRIKD tratará los datos necesarios para las siguientes finalidades primarias, indispensables para crear y mantener la relación jurídica y prestar el Servicio:

• crear, autenticar, administrar y proteger tu Cuenta;
• verificar elegibilidad, mayoría de edad, territorio y acceso;
• entregar el Programa del Atleta seleccionado y personalizarlo mediante el Motor Adaptativo;
• generar Prescripciones de Entrenamiento, sustituciones, progresiones, scores, rachas, gráficas, resúmenes y estadísticas;
• registrar, sincronizar, conservar y mostrar tu actividad de entrenamiento;
• operar perfiles, Canales, Chats, publicaciones, reacciones y demás Funciones de Comunidad;
• filtrar fotografías y mensajes para detectar material objetable y proteger la comunidad;
• recibir, registrar, investigar y resolver reportes, apelaciones, incidentes y escalaciones de Cuentas;
• aplicar bloqueos personales, ocultamientos locales, silenciamientos del Atleta y medidas de STRIKD;
• procesar o verificar compras, Suscripciones, renovaciones, cancelaciones, recibos, reembolsos y restauración de compras;
• enviar comunicaciones operativas, legales, de seguridad, pago, renovación, cancelación y soporte;
• prevenir fraude, accesos no autorizados, abuso, malware, spam, explotación técnica y evasión de restricciones;
• mantener, corregir, asegurar, medir y mejorar el funcionamiento del Servicio;
• atender derechos ARCO, solicitudes de eliminación, reclamaciones y obligaciones de consumidor; y
• cumplir obligaciones legales, fiscales, contractuales, judiciales y de tiendas de aplicaciones, así como ejercer o defender derechos.

Cuando corresponda, STRIKD solicitará una elección separada para finalidades no indispensables, tales como:

• enviar promociones, novedades, recomendaciones comerciales o campañas de Atletas;
• utilizar analítica no esencial o tecnologías de marketing en el sitio web;
• realizar atribución publicitaria o rastreo entre aplicaciones o sitios de terceros cuando requiera permiso del sistema operativo;
• publicar testimonios, fotografías, voz o imagen en campañas externas; y
• utilizar información identificable para investigación, pruebas o entrenamiento de modelos generales fuera de lo necesario para prestar el Servicio.

Podrás negar o retirar estas finalidades sin perder las funciones esenciales, mediante los controles del dispositivo o escribiendo a admin@strikd.ai. La baja de marketing no impide comunicaciones necesarias sobre tu Cuenta, seguridad, pagos, documentos legales o Servicio.

La información sobre lesiones, dolor, limitaciones físicas, estado de salud presente o futuro y otros datos similares puede ser considerada sensible. STRIKD solicitará consentimiento expreso y por escrito mediante un mecanismo electrónico separado, autenticado y no preseleccionado antes de tratarla cuando sea requerido.

STRIKD tratará estos datos únicamente para adaptar el entrenamiento, evitar o sustituir ejercicios, atender reportes de seguridad, mejorar la protección del Usuario y cumplir obligaciones aplicables. El periodo de tratamiento se limitará al mínimo indispensable.

Los Atletas no reciben tus lesiones o limitaciones mediante su panel estándar. Si voluntariamente comunicas información sensible en un Chat, Canal o mensaje dirigido al Atleta, la persona destinataria podrá verla conforme a la audiencia seleccionada.

Podrás retirar el consentimiento sensible. El retiro no afecta tratamientos previos lícitos, pero puede impedir que STRIKD adapte recomendaciones con base en lesiones o limitaciones y puede requerir eliminar o desactivar funciones relacionadas.

El Motor Adaptativo procesa automáticamente perfil, disponibilidad, equipo, historial, rendimiento, progreso, omisiones, limitaciones reportadas y reglas del Programa para generar o modificar ejercicios, cargas, series, repeticiones, descansos, volumen, calendario, fases y otras Prescripciones de Entrenamiento.

Este tratamiento es esencial para la experiencia STRIKD, pero sus resultados son estimaciones fitness, no decisiones médicas. No producen por sí solos efectos jurídicos ni determinan derechos de empleo, crédito, seguro u otros intereses externos. Siempre podrás reducir, cambiar, omitir o detener una recomendación.

Podrás reportar un resultado incorrecto o inseguro y solicitar información general sobre el tratamiento. Cuando la legislación otorgue un derecho de oposición frente a un tratamiento automatizado que produzca efectos jurídicos no deseados o afecte significativamente derechos o libertades, STRIKD lo atenderá conforme al procedimiento ARCO.

Las fotografías y los mensajes podrán ser analizados antes o al momento de publicarse mediante sistemas automatizados destinados a detectar contenido sexual explícito, explotación de menores, violencia gráfica, amenazas, acoso, odio, autolesiones, actividades ilegales, spam, fraude, phishing, enlaces maliciosos y otros materiales prohibidos.

El procesamiento puede generar señales de seguridad, impedir o retrasar una publicación, bloquear un envío, limitar visibilidad o marcar contenido para revisión. Las herramientas pueden cometer errores o no detectar todo el material objetable.

Cuando reportes un mensaje, STRIKD tratará el contenido reportado o una copia probatoria, identificadores de las Cuentas, motivo, Canal, fecha y metadatos necesarios. Los reportes se registran en el backend y pueden notificar al equipo mediante admin@strikd.ai.

La cantidad de reportes, por sí sola, no produce una sanción automática. Las medidas se basan en una evaluación del contenido, contexto, gravedad, evidencia, conducta acreditada y riesgo. STRIKD puede advertir, restringir, retirar globalmente contenido, suspender o terminar una Cuenta cuando corresponda.

Un Atleta podrá recibir o consultar únicamente la información necesaria para operar su Programa y comunidad, según las funciones habilitadas:

• perfil comunitario, nombre de usuario, avatar y estadísticas que hayas decidido hacer visibles;
• actividad o adherencia relacionada con el Programa cuando la interfaz lo comunique;
• métricas agregadas o desidentificadas de su comunidad;
• mensajes, comentarios, publicaciones y reportes que le sean visibles como participante o moderador;
• información necesaria para silenciar temporal o permanentemente a un Usuario; y
• resúmenes o insights sobre el desempeño del Programa que no revelen datos sensibles individuales, salvo instrucción expresa del Usuario.

El Atleta no podrá utilizar los datos para crear bases externas, contactar fuera de STRIKD sin autorización, vender servicios no autorizados, solicitar pagos externos, realizar marketing incompatible o tratar datos para una finalidad distinta.

STRIKD podrá permitir acceso limitado a proveedores que tratan datos por cuenta de STRIKD para prestar funciones necesarias. Las categorías pueden incluir:

• Apple, Google, Stripe u otros Procesadores de Pago y tiendas de aplicaciones;
• hosting, nube, base de datos, almacenamiento, respaldo, entrega de contenido y redes;
• autenticación, prevención de fraude, seguridad, monitoreo y control de acceso;
• notificaciones push, correo electrónico y comunicaciones operativas;
• analítica, rendimiento, diagnóstico de errores y crash reporting;
• filtrado de fotografías y mensajes, moderación y detección de material objetable;
• inteligencia artificial, traducción, subtítulos o resúmenes cuando una función los utilice; y
• asesores jurídicos, contables, auditores y proveedores de soporte sujetos a deberes de confidencialidad.

STRIKD evaluará y contratará a sus proveedores con obligaciones de confidencialidad, seguridad, finalidad, eliminación o devolución y asistencia para derechos. La lista técnica de proveedores activos podrá cambiar; STRIKD mantendrá una versión actualizada en su documentación de privacidad o la pondrá a disposición a solicitud, en la medida compatible con seguridad y secretos comerciales.

Algunos proveedores pueden procesar datos fuera de México, incluyendo Estados Unidos u otros países donde operen. STRIKD comunicará las finalidades y exigirá protecciones contractuales compatibles con este Aviso y la legislación aplicable.

STRIKD podrá realizar transferencias sin consentimiento cuando una ley, tratado o relación jurídica lo permita, por ejemplo para cumplir una Suscripción, procesar una transacción, proteger un interés público, atender una autoridad o ejercer y defender derechos. Para transferencias distintas que requieran consentimiento, STRIKD solicitará una autorización separada.

No se considera transferencia el acceso de una persona encargada que trate datos por cuenta de STRIKD bajo instrucciones y contrato, sin decidir finalidades propias.

STRIKD no vende ni renta datos personales a corredores de datos. Tampoco utiliza ni comparte datos de salud, lesiones, limitaciones o actividad fitness para publicidad comportamental de terceros, marketing de terceros o extracción comercial ajena al Servicio.

Una campaña externa que utilice tu nombre real, rostro, voz, testimonio, fotografía, transformación o publicación requerirá autorización adicional, salvo una compartición que tú mismo hayas solicitado o realizado.

Actualmente, el sitio web de STRIKD no utiliza cookies. Consulta nuestra Declaración sobre cookies del sitio web para conocer su alcance y las actualizaciones correspondientes. Esta declaración no sustituye la información sobre tratamiento de datos personales, SDKs, identificadores y permisos de la aplicación móvil contenida en el Aviso de Privacidad.

La Aplicación puede utilizar SDKs e identificadores técnicos para autenticación, notificaciones, seguridad, compras, analítica o diagnóstico. Si una actividad constituye rastreo entre aplicaciones o sitios de terceros y requiere permiso del sistema operativo, STRIKD solicitará dicho permiso antes de realizarla. Negarte no impedirá el acceso a funciones que no dependan de ese rastreo.

STRIKD conserva cada categoría únicamente durante el tiempo necesario, adecuado y relevante para las finalidades descritas, la relación jurídica, obligaciones legales, seguridad y defensa de derechos. No se aplica un periodo uniforme de quince años a todos los datos.

Cuando los datos dejen de ser necesarios, STRIKD los suprimirá previo bloqueo cuando proceda. La información relativa a un incumplimiento contractual se conservará únicamente durante el periodo legal aplicable y no se utilizará para finalidades incompatibles.

Podrás iniciar la eliminación completa desde la Aplicación, normalmente en Configuración > Cuenta > Eliminar Cuenta. STRIKD podrá solicitar reautenticación y una confirmación para evitar eliminaciones accidentales o no autorizadas.

La confirmación termina inmediatamente tu acceso. STRIKD completará la eliminación o desidentificación de la Cuenta y datos asociados dentro de hasta treinta días, excepto información sujeta a bloqueo o conservación legal. Recibirás una confirmación cuando el proceso se complete.

Las fotografías, videos, publicaciones, mensajes y demás UGC bajo control de STRIKD serán retirados o desidentificados. STRIKD no puede eliminar copias realizadas por destinatarios o publicadas en servicios externos.

Si tienes una Suscripción administrada por Apple o Google, su facturación puede continuar hasta que la canceles en la cuenta correspondiente. El flujo de eliminación te informará y facilitará la administración. STRIKD podrá ofrecer programar la eliminación al final del periodo, siempre que exista también una opción de eliminación inmediata.

Puedes ejercer en cualquier momento los derechos de Acceso, Rectificación, Cancelación y Oposición respecto de tus datos personales, personalmente o mediante representante legal.

Envía la solicitud a admin@strikd.ai con el asunto “Solicitud ARCO”. Deberá incluir:

• tu nombre y domicilio o medio para recibir notificaciones;
• documentos que acrediten tu identidad y, en su caso, la identidad y representación de tu representante;
• descripción clara y precisa de los datos respecto de los que deseas ejercer un derecho, salvo que solicites acceso general;
• el derecho que deseas ejercer y la acción concreta solicitada;
• correo o identificador de la Cuenta y cualquier elemento que facilite localizar los datos; y
• para rectificación, las modificaciones solicitadas y documentos que las sustenten.

STRIKD comunicará su determinación dentro de un máximo de veinte días hábiles desde la recepción de una solicitud completa. Si resulta procedente, la hará efectiva dentro de los quince días hábiles siguientes a la comunicación. Ambos plazos podrán ampliarse una sola vez por un periodo igual cuando las circunstancias lo justifiquen.

El ejercicio es gratuito; sólo podrán cobrarse costos de reproducción, copias o envío permitidos. Una negativa total o parcial será motivada y podrá basarse en falta de acreditación, inexistencia de datos, derechos de terceros, impedimento legal o cumplimiento previo, entre otros supuestos legalmente permitidos.

Puedes revocar consentimiento o limitar uso y divulgación mediante la configuración disponible, los enlaces de baja o escribiendo a admin@strikd.ai. La revocación no tendrá efectos retroactivos.

La revocación de una finalidad necesaria puede impedir prestar una función o mantener la Cuenta. Antes de aplicar una consecuencia material, STRIKD te informará cuando resulte razonablemente posible.

Para dejar de recibir promociones utiliza el enlace de baja. Para permisos del dispositivo utiliza los controles de iOS o Android.

STRIKD mantendrá medidas administrativas, técnicas y físicas razonables considerando sensibilidad, riesgo, consecuencias y tecnología. Pueden incluir controles de acceso, autenticación, cifrado en tránsito, segregación de ambientes, logging, respaldo, gestión de proveedores, revisión de permisos y procedimientos de respuesta a incidentes.

Ningún sistema es absolutamente seguro. Si ocurre una vulneración que afecte de forma significativa derechos patrimoniales o morales, STRIKD informará de forma inmediata a las personas afectadas con información razonable sobre lo ocurrido, los datos comprometidos, recomendaciones y medidas adoptadas.

Para reportar una vulnerabilidad o acceso no autorizado, escribe a admin@strikd.ai sin incluir contraseñas completas ni datos completos de tarjeta.

STRIKD está dirigido exclusivamente a personas de dieciocho años o más. No autoriza Cuentas de menores, incluso con consentimiento de padres o tutores. Si STRIKD detecta datos de una persona menor, podrá bloquear la Cuenta, investigar y eliminar la información salvo conservación legal mínima.

STRIKD podrá modificar este Aviso por cambios legales, técnicos, operativos, de proveedores, funciones o finalidades. La versión actualizada indicará fecha y se publicará en la Aplicación y el sitio. Los cambios materiales se comunicarán con anticipación razonable y se solicitará nuevo consentimiento cuando sea necesario.

STRIKD conservará un historial razonable de versiones para identificar el aviso aplicable a una aceptación o tratamiento.

Sin perjuicio de los mecanismos internos, podrás acudir a la Secretaría Anticorrupción y Buen Gobierno u otra autoridad competente conforme a la legislación vigente.

Aceptar este Aviso acredita que fue puesto a tu disposición, pero no sustituye el consentimiento expreso y por escrito requerido para datos sensibles, renovación automática, Prueba de Calibración, marketing opcional, rastreo sujeto a permiso o uso publicitario de imagen. STRIKD utilizará mecanismos separados cuando corresponda.

This Notice applies to the STRIKD mobile Application; the website; Athlete Program pages; registration, checkout, and Subscription processes; the Adaptive Engine; training features; profiles; Channels and Chats; support; moderation; notifications; and other products or features identified as part of STRIKD.

It does not govern the independent Processing carried out by Apple, Google, Stripe, social networks, gyms, Athletes when acting outside STRIKD, or other third parties that determine their own purposes. You must review their privacy notices where applicable.

STRIKD may process the following categories, depending on the features you use:

STRIKD does not need you to provide detailed clinical diagnoses, complete medical records, biometric identification data, genetic information, or complete financial information to use the ordinary features. Do not send information that is not necessary for the corresponding purpose.

• directly from you, when you create the Account, complete onboarding, log workouts, post, send messages, report content, request support, or exercise rights;
• automatically, when you use the Application, website, webviews, notifications, Adaptive Engine, community features, or security systems;
• from Payment Processors and stores, to confirm purchases, Subscriptions, renewals, cancellations, refunds, and access status;
• from Athletes and other Users, when they interact with you, include you in content, report a message, or escalate an Account; and
• from technical providers that operate on behalf of STRIKD, within the applicable purposes and contractual limits.

This section describes specifically how STRIKD processes the information it receives from Google when you choose to create your Account or sign in with Google (the «Google User Data»). It supplements the rest of this Notice and, as to that data, prevails over the general descriptions.

Sign in with Google works through OAuth 2.0. STRIKD never receives or stores your Google password. We only receive the fields corresponding to the scopes you approve on Google's consent screen.

STRIKD does not request or receive access to your Gmail, Google Drive, Contacts, Calendar, Photos, location, or any other Google service. If a future feature required an additional scope, you would be asked for fresh, specific consent before it is enabled, and you may decline it without losing access to your Account.

Purposes. Google User Data is used solely to provide and improve user-facing features within the Service:

• creating, authenticating, maintaining, and recovering your Account;
• displaying your name and profile photo in your Account and, if you choose to take part, in the Community;
• sending you necessary communications about your Account, your Subscription, and your training;
• preventing fraud, abuse, impersonation, and unauthorized access;
• handling the support you request and identifying your Account when you do;
• complying with applicable legal obligations.

STRIKD does not use Google User Data for any secondary purpose without first obtaining your separate consent, on the terms of the Separate Consents section of this Notice.

Who it may be shared with. Google User Data is shared only in the following cases:

• with Processors that operate the Service's infrastructure on STRIKD's behalf — authentication, hosting, database, notifications, transactional email, support, and product analytics — bound by contract, confidentiality, and STRIKD's instructions, with no right to process it for their own purposes;
• with you and with those you choose: your name and profile photo are visible to other users if you take part in the Community, and you may hide or replace them from the Application;
• where a competent authority requires it under the law, or where it is necessary to exercise or defend STRIKD's rights;
• in a corporate transaction — merger, acquisition, restructuring, or sale of assets — informing you as set out in the Changes to the Notice section and maintaining the level of protection described here.

STRIKD does not sell, rent, or assign Google User Data to data brokers, advertising networks, or any third party for their own purposes.

How it is protected. Google User Data is safeguarded with the following measures:

• encryption in transit over TLS, and encryption at rest in the database and in backups;
• role-based, need-to-know access control, with strong authentication for authorized personnel;
• access logging and review, and strict separation between the production and development environments;
• storage of access and refresh tokens in an encrypted store, revocable at any time and rotated periodically;
• periodic vulnerability assessment and incident-response procedures as set out in the Security and Breaches section of this Notice.

No human reads your Google User Data, except: (i) with your express consent; (ii) where indispensable for security, abuse investigation, or compliance with the law; (iii) on a strictly limited basis to operate or repair the Service where automated processing is not sufficient; or (iv) where the data is aggregated or anonymized and can no longer identify you.

How it is deleted. You may delete Google User Data through two independent routes:

• Revoke STRIKD's access from your Google Account, at myaccount.google.com/permissions. Revoking immediately stops STRIKD from obtaining new information from Google; on its own it does not delete information already stored by STRIKD, for which you must delete your Account.
• Delete your STRIKD Account from the Application, normally under Settings > Account > Delete Account. STRIKD will delete or de-identify your name, email, Google identifier, and profile photo within up to thirty days, except for information subject to a legal hold or retention duty. Encrypted backups are overwritten on the ordinary cycle, which does not exceed ninety days.

You may also request deletion by writing to admin@strikd.ai from the address associated with your Google Account, and exercise your rights of access, rectification, cancellation, and objection as set out in the ARCO Rights section of this Notice.

Limited Use. STRIKD's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. Expressly:

• Google User Data is not sold and is not monetized in any form;
• it is not used or shared for advertising, including personalized advertising, retargeting, audience targeting, or the building of advertising profiles;
• it is not used to train, fine-tune, or evaluate general or foundation artificial-intelligence models, whether STRIKD's own or a third party's;
• STRIKD's Adaptive Engine works only with your training and performance data to personalize your own program within your Account, and does not receive your name, email, or Google profile photo for that purpose.

STRIKD will process the data necessary for the following primary purposes, which are indispensable to create and maintain the legal relationship and provide the Service:

• create, authenticate, administer, and protect your Account;
• verify eligibility, legal age, territory, and access;
• deliver the selected Athlete Program and personalize it through the Adaptive Engine;
• generate Training Prescriptions, substitutions, progressions, scores, streaks, charts, summaries, and statistics;
• record, synchronize, retain, and display your training activity;
• operate profiles, Channels, Chats, posts, reactions, and other Community Features;
• filter photographs and messages to detect objectionable material and protect the community;
• receive, record, investigate, and resolve reports, appeals, incidents, and Account escalations;
• apply personal blocks, local hiding, Athlete mutes, and STRIKD measures;
• process or verify purchases, Subscriptions, renewals, cancellations, receipts, refunds, and restoration of purchases;
• send operational, legal, security, payment, renewal, cancellation, and support communications;
• prevent fraud, unauthorized access, abuse, malware, spam, technical exploitation, and circumvention of restrictions;
• maintain, correct, secure, measure, and improve the operation of the Service;
• handle ARCO rights, deletion requests, complaints, and consumer obligations; and
• comply with legal, tax, contractual, judicial, and app store obligations, as well as exercise or defend rights.

Where applicable, STRIKD will request a separate choice for non-indispensable purposes, such as:

• sending promotions, news, commercial recommendations, or Athlete campaigns;
• using non-essential analytics or marketing technologies on the website;
• carrying out advertising attribution or tracking across third-party applications or sites when it requires operating system permission;
• publishing testimonials, photographs, voice, or image in external campaigns; and
• using identifiable information for research, testing, or training of general models beyond what is necessary to provide the Service.

You may refuse or withdraw these purposes without losing essential features, through the device controls, or by writing to admin@strikd.ai. Unsubscribing from marketing does not prevent communications necessary regarding your Account, security, payments, legal documents, or the Service.

Information about injuries, pain, physical limitations, present or future health status, and other similar data may be considered sensitive. STRIKD will request express, written consent through a separate, authenticated, and non-preselected electronic mechanism before processing it when required.

STRIKD will process this data solely to adapt the training, avoid or substitute exercises, handle security reports, improve User protection, and comply with applicable obligations. The Processing period will be limited to the minimum indispensable.

Athletes do not receive your injuries or limitations through their standard panel. If you voluntarily communicate sensitive information in a Chat, Channel, or message directed to the Athlete, the recipient may see it in accordance with the selected audience.

You may withdraw sensitive Consent. Withdrawal does not affect prior lawful Processing, but it may prevent STRIKD from adapting recommendations based on injuries or limitations and may require deleting or deactivating related features.

The Adaptive Engine automatically processes profile, availability, equipment, history, performance, progress, skips, reported limitations, and Program rules to generate or modify exercises, loads, sets, repetitions, rest periods, volume, calendar, phases, and other Training Prescriptions.

This Processing is essential to the STRIKD experience, but its results are fitness estimates, not medical decisions. They do not by themselves produce legal effects or determine employment, credit, insurance, or other external interests. You may always reduce, change, skip, or stop a recommendation.

You may report an incorrect or unsafe result and request general information about the Processing. Where the law grants a right to object to automated Processing that produces unwanted legal effects or significantly affects rights or freedoms, STRIKD will handle it in accordance with the ARCO procedure.

Photographs and messages may be analyzed before or at the moment of publication through automated systems intended to detect explicit sexual content, child exploitation, graphic violence, threats, harassment, hate, self-harm, illegal activities, spam, fraud, phishing, malicious links, and other prohibited materials.

The processing may generate security signals, prevent or delay a publication, block a submission, limit visibility, or flag content for review. The tools may make errors or fail to detect all objectionable material.

When you report a message, STRIKD will process the reported content or an evidentiary copy, identifiers of the Accounts, reason, Channel, date, and necessary metadata. Reports are recorded in the backend and may notify the team through admin@strikd.ai.

The number of reports, on its own, does not produce an automatic sanction. Measures are based on an assessment of the content, context, severity, evidence, established conduct, and risk. STRIKD may warn, restrict, globally remove content, suspend, or terminate an Account where appropriate.

An Athlete may receive or consult only the information necessary to operate their Program and community, according to the enabled features:

• community profile, username, avatar, and statistics you have decided to make visible;
• activity or adherence related to the Program when the interface communicates it;
• aggregated or de-identified metrics of their community;
• messages, comments, posts, and reports visible to them as a participant or moderator;
• information necessary to temporarily or permanently mute a User; and
• summaries or insights about Program performance that do not reveal individual sensitive data, except at the User's express instruction.

The Athlete may not use the data to create external databases, contact outside STRIKD without authorization, sell unauthorized services, request external payments, carry out incompatible marketing, or process data for a different purpose.

STRIKD may allow limited access to providers that process data on behalf of STRIKD to provide necessary features. The categories may include:

• Apple, Google, Stripe, or other Payment Processors and app stores;
• hosting, cloud, database, storage, backup, content delivery, and networks;
• authentication, fraud prevention, security, monitoring, and access control;
• push notifications, email, and operational communications;
• analytics, performance, error diagnostics, and crash reporting;
• photograph and message filtering, moderation, and detection of objectionable material;
• artificial intelligence, translation, subtitles, or summaries when a feature uses them; and
• legal, accounting, audit, and support providers subject to confidentiality duties.

STRIKD will evaluate and engage its providers with obligations of confidentiality, security, purpose, deletion or return, and assistance with rights. The technical list of active providers may change; STRIKD will maintain an updated version in its privacy documentation or make it available upon request, to the extent compatible with security and trade secrets.

Some providers may process data outside Mexico, including the United States or other countries where they operate. STRIKD will communicate the purposes and require contractual protections compatible with this Notice and the applicable law.

STRIKD may carry out Transfers without Consent when a law, treaty, or legal relationship allows it, for example to fulfill a Subscription, process a transaction, protect a public interest, respond to an authority, or exercise and defend rights. For other Transfers that require Consent, STRIKD will request a separate authorization.

The access of a Data Processor that processes data on behalf of STRIKD under instructions and a contract, without deciding its own purposes, is not considered a Transfer.

STRIKD does not sell or rent Personal Data to data brokers. Nor does it use or share health, injury, limitation, or fitness activity data for third-party behavioral advertising, third-party marketing, or commercial extraction unrelated to the Service.

An external campaign that uses your real name, face, voice, testimonial, photograph, transformation, or post will require additional authorization, except for a sharing that you yourself have requested or carried out.

The STRIKD website does not currently use cookies. Please refer to our Website Cookie Notice for its scope and updates. This notice does not replace the information about personal data processing, SDKs, identifiers, and mobile application permissions contained in the Privacy Notice.

The Application may use SDKs and technical identifiers for authentication, notifications, security, purchases, analytics, or diagnostics. If an activity constitutes tracking across third-party applications or sites and requires operating system permission, STRIKD will request such permission before carrying it out. Refusing will not prevent access to features that do not depend on that tracking.

STRIKD retains each category only for the time necessary, appropriate, and relevant for the purposes described, the legal relationship, legal obligations, security, and defense of rights. A uniform fifteen-year period does not apply to all data.

When the data ceases to be necessary, STRIKD will delete it after blocking where appropriate. Information relating to a contractual breach will be retained only during the applicable legal period and will not be used for incompatible purposes.

You may initiate complete deletion from the Application, normally in Settings > Account > Delete Account. STRIKD may request re-authentication and a confirmation to avoid accidental or unauthorized deletions.

Confirmation immediately terminates your access. STRIKD will complete the deletion or de-identification of the Account and associated data within up to thirty days, except for information subject to a legal hold or retention. You will receive a confirmation when the process is completed.

Photographs, videos, posts, messages, and other UGC under STRIKD's control will be removed or de-identified. STRIKD cannot delete copies made by recipients or published on external services.

If you have a Subscription managed by Apple or Google, its billing may continue until you cancel it in the corresponding account. The deletion flow will inform you and facilitate management. STRIKD may offer to schedule deletion at the end of the period, provided there is also an immediate deletion option.

You may exercise at any time the rights of Access, Rectification, Cancellation, and Objection with respect to your Personal Data, personally or through a legal representative.

Send the request to admin@strikd.ai with the subject "ARCO Request". It must include:

• your name and domicile or means to receive notifications;
• documents proving your identity and, where applicable, the identity and representation of your representative;
• a clear and precise description of the data with respect to which you wish to exercise a right, unless you request general access;
• the right you wish to exercise and the specific action requested;
• email or Account identifier and any element that helps locate the data; and
• for rectification, the requested modifications and documents supporting them.

STRIKD will communicate its determination within a maximum of twenty business days from receipt of a complete request. If it is well-founded, it will make it effective within the fifteen business days following the communication. Both periods may be extended once for an equal period when the circumstances justify it.

Exercise is free of charge; only permitted costs of reproduction, copies, or shipping may be charged. A total or partial denial will be reasoned and may be based on lack of proof, non-existence of data, third-party rights, legal impediment, or prior compliance, among other legally permitted grounds.

You may revoke Consent or limit use and disclosure through the available settings, the unsubscribe links, or by writing to admin@strikd.ai. Revocation will not have retroactive effects.

The revocation of a necessary purpose may prevent providing a feature or maintaining the Account. Before applying a material consequence, STRIKD will inform you where reasonably possible.

To stop receiving promotions, use the unsubscribe link. For device permissions, use the iOS or Android controls.

STRIKD will maintain reasonable administrative, technical, and physical measures considering sensitivity, risk, consequences, and technology. They may include access controls, authentication, encryption in transit, environment segregation, logging, backup, provider management, permission review, and incident response procedures.

No system is absolutely secure. If a breach occurs that significantly affects property or moral rights, STRIKD will immediately inform the affected persons with reasonable information about what happened, the data compromised, recommendations, and measures adopted.

To report a vulnerability or unauthorized access, write to admin@strikd.ai without including complete passwords or complete card data.

STRIKD is directed exclusively at persons eighteen years of age or older. It does not authorize minors' Accounts, even with the consent of parents or guardians. If STRIKD detects data of a minor, it may block the Account, investigate, and delete the information except for a minimum legal retention.

STRIKD may modify this Notice due to legal, technical, operational, provider, feature, or purpose changes. The updated version will indicate the date and will be published in the Application and the site. Material changes will be communicated with reasonable advance notice, and new consent will be requested when necessary.

STRIKD will keep a reasonable history of versions to identify the notice applicable to an acceptance or Processing.

Without prejudice to the internal mechanisms, you may turn to the Secretariat of Anti-Corruption and Good Governance or another competent authority in accordance with the applicable law.

Accepting this Notice evidences that it was made available to you, but does not replace the express, written consent required for Sensitive Personal Data, automatic renewal, Calibration Test, optional marketing, permission-based tracking, or advertising use of image. STRIKD will use separate mechanisms where appropriate.
